How we work

Three steps. No surprises. No hourly bills.

You've been through enough surprises already. Here's exactly what working with us looks like, from the first call to the last check.

01

Call us, day or night.

A real person picks up. You'll talk with Joe or a senior member of the team, not an intake screener. We'll listen, take notes, and tell you what we think.

— Free · No obligation
02

We investigate and build the case.

We gather the police report, medical records, black-box data, witness statements, and everything the insurer would rather you never see. You focus on healing.

— We front every cost
03

We settle, or we try it.

Most cases resolve through negotiation. If an insurer lowballs, we prepare the case for trial.

— No fee unless we win

About the Firm

Small town roots. Lowcountry values. Still answers the phone.

Joe grew up in a town of only 500, where his father was an attorney and later was a Justice on the state Supreme Court. In college, Joe studied Ocean Engineering before finding his way back to law, and has practiced in Charleston ever since. He served South Carolina's First Congressional District in the 116th Congress before returning to private practice full-time.

i.
You talk to Joe. Not a gatekeeper.
Every client gets Joe's cell number on day one. No call centers, no intake queues.
ii.
We try cases. That's why insurers settle.
Insurance companies know what firms are willing to try a case. Joe has tried numerous cases throughout South Carolina and Kentucky.
iii.
The first offer is rarely the real one.
Insurers open low to test you. We run the numbers on your future medical costs, lost earning capacity, and life-care plan before we even respond to their offer.
iv.
We only get paid if you do.
A straightforward contingency fee. No hourly bills, no retainer, no “costs” invoice in the mail. You pay nothing unless we recover.

“I had a fantastic experience working with Joe Cunningham Law. Joe helped me settle an insurance claim and did an outstanding job — knowledgeable, efficient and truly had my best interests at heart. Attorney Aaron Scheer was equally thorough and professional, ensuring every detail was handled with care. I'm deeply grateful for their expertise and highly recommend Joe Cunningham Law to anyone seeking skilled and trustworthy representation.”

FAQ

Common Questions

If your question isn't here, just call.

Nothing up front, and nothing at all if we don't recover for you. Our fee is a straightforward contingency percentage, taken out of the recovery at the end. We also front all case expenses. If we lose, we eat those costs. You never get an invoice from us.
Simple auto collisions can settle in as little as 3 months; complex medical malpractice and wrongful death cases can take longer. We'll give you an honest timeline on our first call.
South Carolina uses modified comparative negligence: you can still recover as long as you're 50% or less at fault, with your recovery reduced by your share. Don't assume you have no case; we've taken plenty of cases where insurers said our client was the one to blame, and recovered significant money.
Most cases settle before trial. But we prepare every case as if it's going to trial from day one, and our discipline in preparation is why insurers end up offering more money to settle your case.
Sooner is always better. Evidence disappears quickly: skid marks, surveillance footage, witnesses move. South Carolina has a strict 3-year statute of limitations on most injury cases. But even if it's been a while, call us. We'll tell you honestly if there's still a case.
